Fighting for Justice

Obtaining justice for the honest person who is seriously injured is the law's highest calling.

Why I Do This

It was my first jury trial in 1985. She could barely speak English. Her husband had abandoned her. One of her sons had Down syndrome. Southern California Gas Company was suing to take her house. I was her only hope.

I realized something during that trial: I truly loved her as a client. Not the professional distance they teach you in law school, but real love—the kind that makes you work through the night, that makes you refuse to accept defeat, that makes you stand in front of twelve strangers and put everything on the line for someone who can do nothing for you in return.

We won. The jury awarded $450,000 on $15 in special damages.

But more importantly, I learned who I was supposed to be as a lawyer.

“I tell every potential client: ‘I can’t go to trial for you unless I feel true love for you.’ That’s not poetry. That’s truth. If I don’t love my client—if I don’t understand their pain, their fear, their need for justice—I can’t be their warrior.”

The Price of Taking Up Space

My father never went to law school, but he was the greatest orator I ever heard. He also taught me the most important lesson of my life: “Caring for people is the price of taking up space on earth.”

He lived that truth every day. When boys on his baseball team needed a father figure, he called them “Son.” When people struggled with addiction, he visited them—and kept visiting long after they overcame.

I didn’t consciously decide to practice law the way my father lived his life. It was ingrained in me so deeply that I just did it. Only now, after almost 200 civil jury trials and more than 45 years of practice, can I see how profoundly he shaped the lawyer I became.

Permission to Love

By 1996, I’d been practicing law for more than sixteen years. I’d won significant cases. But something was missing.

Then I met Gerry Spence at his Thunderhead Ranch in Wyoming. I had to borrow money to afford the 31-day program. It became one of the most important things I’ve ever done.

Gerry taught me something I’d always felt but didn’t have permission to express: “You have to get out of your head and into your heart.”

He gave me permission to be who I truly was. He taught me that the most powerful weapon in the courtroom isn’t technique or clever cross-examination. It’s love. Real, genuine love for the client whose story you’re telling.

Why I Jump Into Deep Water

I’m known as “The Last Minute Trial Lawyer.” Attorneys call me days or weeks before trial with cases they can’t handle or won’t take. Cases other lawyers have rejected. “Hopeless” cases.

I’ve been hired one week before a five-week legal malpractice trial (verdict: $21 million). Three weeks before a nine-week wrongful termination trial (verdict: $4 million). Four days before a six-week insurance bad faith trial (verdict: $350,000).

Why do I keep jumping?

Because I see these cases with fresh eyes—like a child discovering the world. I’m not burdened by years of legal skirmishes. I see the case the same way a jury will see it: for the first time, with curiosity and wonder.
